Subsequent to listing on the NPL, an Administrative Order by
Consent (AOC), Docket No. CERCLA 01-2003-0021, and
a Statement of Work (SOW) to perform a Remedial
Investigation/Feasibility Study (RI/FS) were negotiated with the United States Environmental
Protection Agency (EPA) Region I and
the Massachusetts Department of Environmental Protection (MADEP). Paragraph 6 of the AOC states that the objectives of the
RI/FS are:
(i) To determine the nature and extent of contamination and
any threat to the public health, welfare, or the environment
caused by the release or threatened release of hazardous
substances, pollutants, or contaminants from the Site by
conducting certain studies including a remedial investigation
(RI);
(ii) To determine and evaluate alternatives for removal or
remedial action (if any) to prevent, mitigate or otherwise
respond to or remedy any release or threatened release of
hazardous substances, pollutants, or contaminants from the Site
by conducting a feasibility study (FS) and/or an engineering
evaluation / cost analysis (EE/CA);
(iii) To reimburse certain response costs of the EPA; and,
(iv) To resolve the claims of the Respondents which have been
or could have been asserted against the United States with
respect to the performance of the Work and reimbursement of
certain response costs as provided in this Order.
The RI/FS work is being primarily funded by
Federal Agencies that used NMI and/or Starmet to perform
manufacturing operations. A
small portion of the cost was paid by the “Respondents to the
AOC”, which include several companies that briefly owned or
operated the facility.
The Respondents have retained de maximis, inc. (de
maximis) as their Project Coordinator to manage and direct all
work under the AOC at the Site. de maximis will also act as the General Contractor for
the project and will hire other companies as necessary to
perform the work.
The intent
of this website is to efficiently distribute information to the
community of Concord, MA and other stakeholders. Community
participation continues to be an important component of the
Nuclear Metals Superfund Site for several reasons. First, an
active Community Involvement Plan (CIP) (a requirement of the
National Contingency Plan) has been developed in conjunction
with the EPA. More importantly, the CIP for the NMI Site
reflects de maximis’ commitment to two-way communication that
not only keeps the stakeholders informed about site progress,
but also provides an opportunity for public feedback and input
on site decisions. More information regarding community

The de maximis
project team is made up of three firms: MACTEC,
GeoSyntec
Consultants, and Gradient
Corporation.
This site has been the subject of extensive prior remedial
investigations and remedial work under other programs.

Reports). Site information is also available at the
Concord Free Library.
The
database provided on this website is comprised of sample
information and data collected during RI/FS investigation at the
Nuclear Metals Superfund Site. This information is currently
being used to refine a site conceptual model to write the
Remedial Investigation/Feasibility Study (RI/FS) Reports. As
the RI/FS process is advanced, this website will be continuously
updated to include final documents and sample information for
public review and comment.
